TERMS AND CONDITIONS OF SALE AND WEBSITE USE


1. Introduction

These terms apply to your use of humbleoffice.com.au and to all quotes, orders, sales, deliveries, and installations by Humble Office Pty Ltd (ABN 38 659 583 801) (Humble Office, we, us, our).
By using our website, placing an order, or receiving services, you agree to be bound by these terms. If you do not agree, you must not use this website or purchase from us.

2. Website Use and Intellectual Property

All content on our website, including text, images, graphics, logos, designs, and downloads, is owned or licensed by Humble Office. You may not copy, modify, publish, distribute, reverse engineer, or otherwise use our intellectual property without written consent.
You must not use the website unlawfully or in a way that interferes with other users or the website’s operation.

3. Orders, Pricing, and Payment

3.1 All prices are in Australian dollars (AUD) and exclude delivery unless stated otherwise. Prices may change without notice.
3.2 Quotes are valid for 7 days unless otherwise specified. Stock is reserved only once payment is received in full.
3.3 Full payment is required before dispatch or booking of installation. We do not offer credit accounts.
3.4 We may refuse or cancel an order at our discretion, including for error, unavailability, or failed payment. If cancelled after payment, any undelivered items will be refunded.
3.5 Orders delayed by the customer for more than 4 weeks after confirmation may incur storage charges of 5% of the total order value per month.

4. GST

All prices and charges are exclusive of GST unless stated otherwise. GST will be added at the prevailing rate and included on your tax invoice.

5. Delivery and Installation

5.1 Standard delivery occurs Monday to Friday between 9:00am and 5:00pm. Standard service covers two-person, ground-floor delivery with normal access.
5.2 Additional fees apply for stairs, lifts, limited access, multi-person handling, after-hours or weekend delivery, assembly, and rubbish removal.
5.3 All pods and meeting booths must be delivered and assembled by Humble Office or our authorised contractors. Third-party handling or self-assembly is not permitted and voids warranty.
5.4 The customer must ensure safe, clear, and level access; protect floors and surfaces; and arrange loading dock or lift bookings where needed (minimum 3.2m clearance).
5.5 Humble Office is not responsible for moving existing furniture, clearing access, or any damage to property, including walls, floors, doors, or lifts, during normal delivery or installation.
5.6 If site access is unavailable or unsafe upon arrival, or the site is not ready, additional labour, waiting time, or redelivery fees may apply. Failed delivery or installation fees are non-refundable.
5.7 Delivery times are estimates only. We are not liable for delays caused by freight carriers, traffic, weather, customs, site restrictions, or other events beyond our control.
5.8 We may deliver orders in instalments; each instalment is treated as a separate order.

6. Risk, Title, and Storage

6.1 Risk, including loss, damage, theft, or deterioration, passes to the customer upon delivery to site or collection by the customer’s carrier.
6.2 Title to goods transfers only after full payment is received. Until then, goods remain our property and must not be resold, moved, or modified.
6.3 If delivery is delayed by the customer for more than 14 days after goods are ready, we may charge storage at 5% of the invoice value per month. Prepayment may be required before release.

7. Inspection, Damage, and Claims

7.1 Customers must inspect goods upon delivery and report any damage, short supply, or incorrect delivery within 48 hours to sales@humbleoffice.com.au, including photos of packaging and affected items.
7.2 Reports outside this timeframe may affect carrier insurance but do not limit rights under the Australian Consumer Law.
7.3 Minor marks, colour or grain variations, and reasonable manufacturing tolerances are not considered defects.

8. Returns and Cancellations

8.1 We do not accept change-of-mind returns under any circumstances.
8.2 Orders cannot be cancelled once confirmed, unless agreed to in writing by Humble Office.
8.3 If a cancellation is approved at our discretion, a restocking or administration fee of up to 50% of the order value may apply to cover handling, storage, and processing costs.
8.4 Returns are only accepted if goods are faulty, not as described, or otherwise required under the Australian Consumer Law.
8.5 Clearance, ex-display, pre-order, made-to-order, or customised products are final sale and non-returnable.
8.6 Freight, assembly, and installation charges are non-refundable.

9. Warranty

9.1 All Humble Office products include a 3-year structural warranty from the date of purchase against defects in materials and workmanship.
9.2 The following components carry a 1-year warranty from the date of purchase:

  • Lighting assemblies and LED drivers
  • Ventilation fans and fan modules
  • Control panels, switches, sensors, and PCB modules
  • Electrical components (power rails, sockets, USB/charging outlets, transformers, internal wiring)
  • Fixtures and fittings (hinges, locks, handles, soft-close devices, hardware)
  • Furniture supplied within the pod (chairs, stools, benches, worktops, shelves)

9.3 Exclusions: Warranty does not cover misuse, neglect, improper installation, abnormal conditions (moisture, heat), normal wear and tear, colour/grain variations, cosmetic marks, or unauthorised modifications.
9.4 Any alterations, drilling, painting, reassembly, or modifications by third parties void the warranty.
9.5 We may require evidence such as photos or videos or a return of goods to our warehouse for inspection. At our discretion, we may repair, replace, or refund.
9.6 Third-party accessories or components are covered by their manufacturer’s warranty.
9.7 Call-outs, maintenance, or inspections unrelated to a confirmed manufacturing defect attract a minimum fee of $250 + GST, payable before attendance.

10. Australian Consumer Law

Nothing in these terms excludes or limits your non-excludable rights under the Australian Consumer Law.
Our goods come with guarantees that cannot be excluded under the ACL. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage.
Where goods are not ordinarily acquired for personal, domestic, or household use, our liability is limited, at our option, to repair, replacement, supply of equivalent goods, or reimbursement of the cost of doing so.

11. Limitation of Liability

To the maximum extent permitted by law:
We are not liable for indirect, incidental, or consequential loss, including loss of profit, revenue, or business.
Our total liability is limited to the amount paid for the goods.
We are not responsible for property damage, unsafe site conditions, or third-party interference during delivery or installation.
You indemnify Humble Office for any claims, costs, or losses arising from unsafe access, unprepared sites, or actions by you or your contractors.

12. Fit for Purpose and Product Variations

You are responsible for verifying that all specifications, finishes, and site conditions are suitable before ordering.
Advice provided by Humble Office is general only and not a guarantee of fitness for purpose.
Natural materials and textiles may vary in colour, shade, grain, texture, or weight. Such variations are not considered faults.

13. Online Orders

Placing an order online constitutes an offer to purchase under these terms.
We will confirm acceptance upon dispatch or collection readiness.
Orders cannot be varied or cancelled once accepted unless required by law.
We are not liable for transmission errors, unauthorised transactions, or delays caused by third-party payment systems.

14. Privacy

We collect, use, and store personal information in accordance with the Privacy Act 1988 (Cth) and our Privacy Policy.
Your information may be used to process orders, arrange delivery, provide service updates, and communicate marketing offers.

15. Subcontracting

We may subcontract the design, manufacture, delivery, or installation of goods without notice. This does not affect your rights under these terms.

16. Force Majeure

We are not liable for delay or failure to perform caused by events beyond our control, including natural disasters, industrial disputes, transport delays, supplier issues, government action, or accidents.

17. Notices

Notices to Humble Office should be sent to info@humbleoffice.com.au or our registered address.
Notices to you may be sent to your last known email or business address and are deemed received the next business day after sending by email or two business days after posting.

18. Severability and Waiver

If any part of these terms is invalid or unenforceable, it will be modified or severed to the minimum extent necessary. The remainder continues in full force.
Failure to enforce a term is not a waiver of any rights.

19. Assignment

You must not assign or transfer your rights or obligations under these terms without our written consent. We may assign our rights with notice.

20. Governing Law and Jurisdiction

These terms are governed by the laws of Victoria, Australia.
You agree to the exclusive jurisdiction of the courts of Victoria.

21. Entire Agreement and Amendments

These terms, together with your order and any written variation, form the entire agreement between you and Humble Office.
We may update these terms by publishing a revised version on our website. The version in force at the time of your order applies.
