• The warranty does not cover damage caused by misuse, abuse, accident, modification, improper installation, or any other causes not arising from defects in materials or workmanship.
• Any implied warranties, including those of merchantability and fitness for a particular purpose are limited to the duration of this limited warranty. 
• Humble Office will not be liable for any indirect, special, incidental, or consequential damages arising from the use of the product. 
• Humble Office reserves the right to change the terms and conditions of this warranty, or to modify or discontinue the warranty at any time, without prior notice. 
• The warranty is only valid to the original purchaser of the product and is not transferable.
• Humble Office warranties will be applied from the date of purchase for 2 years, not from the date of delivery.

5. Limitations and exclusions of liability

• We shall not be liable for any direct, indirect, incidental, consequential, or punitive damages, or any other damages or losses, including without limitation lost profits or lost data, arising out of or related to the use, misuse, or inability to use the products sold on Humble Office's website. 
• Our liability shall be limited to the purchase price of the products sold. 
• We shall not be liable for any damages caused by any third party or by any event outside of its reasonable control. 
• We shall not be liable for any damages caused by misuse or abuse of the products. 
• We shall not be liable for any damages caused by any malfunction of the products due to customer negligence or lack of maintenance. 
• We shall not be liable for any damages caused by any unauthorized repairs or modifications to the products. 
• We shall not be liable for any damages caused by any improper installation or use of the products. 
• We shall not be liable for any damages caused by any normal wear and tear of the products. 
• We shall not be liable for any damages caused by any natural disasters, such as floods, fires, earthquakes, etc. 
• We shall not be liable for any damages caused by any negligence on the part of the customer. 
• The customer understands that they are solely responsible for their own safety and security while using the products purchased from Humble Office.

6. Indemnity

i.  The User agrees to indemnify and hold harmless Humble Office, its affiliates and its respective officers, directors, employees, agents and representatives (collectively, “Indemnified Parties”) from and against any and all losses, expenses, damages and costs, including reasonable attorneys' fees, resulting directly or indirectly from any claim, demand, action, proceeding or other assertion by any third party due to or arising out of: 

• the User's use of the Humble Office website; 
• the User's breach of these terms and conditions; 
• any content or materials provided by or on behalf of the User; 
• any violation of any applicable laws, rules or regulations; 
• any negligence or misconduct of the User; or 
• any claim that any content or materials provided by or on behalf of the User infringe or otherwise violates the rights of any third party. 

ii. The User agrees to cooperate fully with the Indemnified Parties in the defence of any such claim. Humble Office reserves the right, at its own expense, to assume the exclusive defence and control of any matter subject to indemnification by the User and the User agrees to cooperate with Humble Office in the defence of these claims. 

iii. The User will not settle any claim without the prior written consent of the Humble Office. 

iv. This indemnity shall survive the termination of these terms and conditions.

7. Severability           

If any provision of these Terms is found to be invalid or unenforceable, such provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable, and the remainder of these Terms shall remain in full force and effect.

The invalidity or unenforceability of any provision of these Terms shall not affect the validity or enforceability of any other provision of these Terms, all of which shall remain in full force and effect.

• Humble Office will provide a warranty for phone booths and meeting pods for up to 2 years from the date of purchase. 
• Humble Office will provide delivery and installation service for phone booths and meeting pods. 
• Humble Office reserves the right to modify these exceptions at any time without prior notice. 
• If a customer has any questions about these terms and conditions, they should contact Humble Office directly.

10. Unenforceable provisions

• Humble Office will not be liable for any indirect, consequential, special, exemplary, or punitive damages, including but not limited to loss of profits, data, use, or other intangible losses, arising out of or in connection with the use of our products. 
• Humble Office will not be liable for any damages caused by the misuse or improper installation of our products. 
• Humble Office will not be responsible for any delays or failures in performance due to acts of God, strikes, lockouts, or other labor disputes, shortages of materials, governmental regulations, or any other causes beyond our control. 
• Humble Office does not guarantee that our products will meet specific customer requirements. 
• The customer is responsible for inspecting the products upon delivery and notifying Humble Office of any damages or discrepancies within 7 days.

This Agreement (the “Agreement”) is entered into by and between Humble Office, LLC (“Humble Office”) and the user (“User”) of Humble Office’s products and services (collectively, the “Services”). By using the Services, User agrees to be bound by the terms and conditions of this Agreement. If User does not agree to the terms and conditions of this Agreement, User may not use the Services.

b) Description of Services. 

Humble Office provides a variety of products, including phone booths and meeting pods, that are designed to improve the overall work environment for businesses, organizations, and individuals. 

c) Payment Terms. 

User agrees to pay for Services in full upon ordering. Humble Office reserves the right to change the prices of Services at any time without prior notice. 

d) Shipping and Delivery. 

Humble Office will make every effort to deliver products on time and in good condition. In the event when user book their own delivery that a product is damaged or lost during shipping, User will be responsible for filing a claim with the shipping company. 

e) Warranty. 

All products sold by Humble Office are covered by a two-years limited warranty. This warranty covers any defects in materials or workmanship but does not cover regular wear and tear. 

f) Limitation of Liability. 

In no event shall Humble Office be liable for any indirect, incidental, special, or consequential damages, including but not limited to, lost profits or lost data, arising out of the use, misuse, or inability to use the Services. 

g) Governing Law. 

This Agreement shall be governed by and construed in accordance with the laws of the State of Victoria, Australia, without giving effect to any choice or conflict of law provision or rule. 

h) Arbitration. 

Any disputes arising out of or related to this Agreement shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in Victoria, Australia. 

i) Severability. 

If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. 

j) Entire Agreement. 

This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes and replaces all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter. 

Any waiver of any provision of this Agreement will be effective only if in writing and signed by Humble Office.

13. Governing law and jurisdiction

These Terms of Use ("Terms") apply to the use of the Humble Office website and services, which are operated by Humble Office ("Company"), based in Australia.
